1. Acceptance of Terms

These Terms & Conditions ("Terms") govern your access to and use of maisonpupa.com (the "Site") and any purchase you make from Maison Pupa ("we," "us," or "our"). By accessing the Site or placing an order, you agree to be bound by these Terms. If you do not agree, please do not use the Site.

We may update these Terms from time to time, as described in Section 13. Continued use of the Site after changes take effect constitutes your acceptance of the revised Terms.

2. Eligibility

You must be at least 18 years old, or the age of majority in your province or territory, to place an order on the Site. By placing an order, you confirm that you meet this requirement and that any information you provide is accurate and complete.

3. Products & Descriptions

We take care to describe and photograph our products accurately, including materials, dimensions, and stone characteristics. However:

• Colors may vary slightly depending on your screen settings.
• Because we use genuine velvet and natural stones, minor variation in color, pattern, and texture between individual pieces is expected and is not considered a defect.
• We reserve the right to limit quantities, discontinue a product, or correct errors in product descriptions or pricing at any time, without prior notice.

4. Pricing & Payment

All prices are listed in US dollars (USD) unless shown in your local currency, and are subject to change without notice. Applicable taxes and shipping costs will be calculated and displayed at checkout.

Payment is processed securely through our third-party payment provider at the time of order. By submitting payment information, you represent that you are authorized to use the payment method provided. We reserve the right to refuse or cancel an order at our discretion, including in cases of suspected fraud, pricing errors, or unavailability of product.

5. Order Acceptance

Your order is an offer to purchase, which we may accept or decline. A confirmation email does not guarantee acceptance of your order; we will notify you if we are unable to fulfill it, and any payment collected will be refunded.

6. Shipping & Delivery

As pieces are made to order, please allow the processing time stated on the product page before your order ships. Estimated delivery windows provided at checkout are estimates only and are not guaranteed. We are not responsible for delays caused by the carrier, customs, or other circumstances beyond our reasonable control.

Risk of loss and title for products purchased pass to you upon our delivery to the shipping carrier. For full details, see our Shipping page.

7. Returns & Exchanges

Our return and exchange policy is set out on our Returns & Exchanges page, which forms part of these Terms. In general, eligible items may be returned or exchanged within 14 days of delivery, provided the item is unworn and in its original packaging. Return shipping is at your cost unless the item arrived damaged, defective, or incorrect. Custom or personalized items are final sale.

8. Intellectual Property

All content on the Site — including text, images, product designs, logos, and the Maison Pupa name and mark — is the property of Maison Pupa or its licensors and is protected by applicable intellectual property laws. You may not reproduce, distribute, modify, or otherwise use any content from the Site without our prior written consent, except as necessary for personal, non-commercial use in connection with a purchase.

9. Acceptable Use

You agree not to:

• Use the Site for any unlawful purpose or in violation of these Terms;
• Attempt to gain unauthorized access to the Site, its systems, or related networks;
• Interfere with the proper functioning of the Site;
• Use automated means to access or extract data from the Site without our permission;
• Impersonate any person or entity, or misrepresent your affiliation with any person or entity.

10. Limitation of Liability

To the fullest extent permitted by applicable law, Maison Pupa shall not be liable for any indirect, incidental, special, or consequential damages arising out of or related to your use of the Site or purchase of any product, even if we have been advised of the possibility of such damages.

Our total liability arising from any order shall not exceed the amount you paid for the product giving rise to the claim. Nothing in these Terms limits any liability that cannot be limited or excluded under applicable Canadian law.

11. Indemnification

You agree to indemnify and hold Maison Pupa harmless from any claims, losses, liabilities, and expenses (including reasonable legal fees) arising out of your breach of these Terms or your misuse of the Site.

12. Governing Law & Disputes

These Terms are governed by the laws of the Province of British Columbia and the federal laws of Canada applicable therein, without regard to conflict of law principles. You agree that any dispute arising from these Terms or your use of the Site will be subject to the exclusive jurisdiction of the courts located in British Columbia.

If you are a consumer located outside Canada, mandatory consumer protection laws of your country of residence may also apply and are not overridden by this section.

13. Changes to These Terms

We may revise these Terms from time to time to reflect changes in our business, our products, or applicable law. The updated version will be indicated by a revised "Last updated" date at the top of this page.

1. General Statement

We take your privacy seriously and are committed to protecting it. This Privacy Policy explains how Maison Pupa collects, uses, and discloses personal information gathered through our website maisonpupa.com (the "Site"), and when you contact us or place an order.

2. Who We Are

"Maison Pupa," "we," "us," and "our" refer to Maison Pupa, a business based in British Columbia, Canada, and the controller of your personal data for the purposes of this Privacy Policy.

3. What Personal Data We Collect, and How

3.1 Information you provide directly to us

You may provide us with information when you create an account, subscribe to our newsletter, place an order, or contact customer support — which may include your name, contact details, order history, payment information, and any messages or photos you share with us.

3.2 Information collected indirectly

When you use the Site, we may automatically collect your IP address, device and browser type, and browsing behaviour, through cookies and similar technologies.

3.3 Minimum age

We do not knowingly collect personal data from individuals under the age of 16.

4. Why We Collect Your Data, and How We Use It

We use your personal data to process and deliver your order, respond to inquiries, send marketing communications where you've opted in, detect and prevent fraud, improve the Site, and comply with our legal and tax obligations.

5. Promotional Communications

With your express prior consent, we may send you information about products, offers, or updates from Maison Pupa. You may withdraw this consent at any time using the "unsubscribe" link in any marketing email we send.

6. How Long We Keep Your Data

We retain your personal data only for as long as necessary for the purposes described in this policy, including to fulfill legal, accounting, or reporting requirements.

7. How We Disclose and Transfer Your Data

We do not sell your personal data. We disclose it only as necessary to operate our business — to payment processors, shipping and fulfillment partners, and hosting or analytics providers. As we are based in Canada, some service providers may be located outside Canada, including in the United States.

8. How We Protect Your Data

We use reasonable administrative, technical, and physical safeguards to protect your personal data from unauthorized access, use, or disclosure. No method of transmission over the internet is completely secure, and we cannot guarantee absolute security.

9. Your Rights

As a business based in British Columbia, we handle your personal data in accordance with BC's Personal Information Protection Act (PIPA) and, where applicable, the federal PIPEDA. Depending on where you live, you may have the right to access, correct, or request deletion of your data, withdraw consent, object to certain processing, or lodge a complaint with the Office of the Information and Privacy Commissioner for British Columbia.
